US House Passes ‘Born Alive’ Bill: The Born-Alive Abortion Survivors Protection Act was approved by the House of Representatives on Wednesday with a vote of 220-210. If passed, the law would oblige medical professionals to provide for a child born alive after an unsuccessful abortion.

The plan would need to be approved by the Senate and signed by President Joe Biden to become law, which seems improbable. The bill and a second anti-abortion bill, according to Senate Majority Leader Chuck Schumer, D-New York, are “doomed in the Senate” and “extreme.”

Schumer stated, “American women deserve to have their right to healthcare safeguarded, not compromised.”

Infants born alive after failed abortions are incredibly uncommon. According to a department of health report, there were over 10,000 abortions done in Minnesota in 2017 but just three instances where an infant was born alive. None did so afterward.

The second abortion law approved by the House would forbid violence against places of abortion, organizations, and places of worship.

Federal protections for abortion rights were repealed in June after the US Supreme Court reversed Roe v. Wade. Since then, practically all abortion services have been abolished in at least 14 states.

Healthcare professionals would be obligated to exert the same level of care as reasonably offered to a child born alive at the same gestational age under the Born-Alive Abortion Survivors Protection Act and ensure the kid is admitted to a hospital. After an unsuccessful abortion, a baby born alive would be entitled to the legislation’s protections.

Additionally, if the law is passed, healthcare practitioners who decline to give the care would face criminal consequences. The law further stipulates that any healthcare professional or employee aware of a violation of the law must inform police authorities.

According to the law, people who refuse to provide care or fail to report will be subject to a fine, up to five years in prison, or both. A person who kills or attempts to kill a newborn who is born alive may be charged with murder, according to the law. However, under current law, a person who kills an infant would already be charged with murder. According to the legislation, mothers who seek medical abortions are not susceptible to criminal prosecution.

However, women could file a civil lawsuit for breaking this legislation against medical professionals or other workers in the healthcare system. According to the bill, they may demand monetary compensation for emotional and physical harm, statutory damages equal to three times the cost of the abortion, and punitive damages.
